Terms of Service

These Terms of Service (“Terms”) apply to your use of BusFit (the “App”), operated by EASYGOAT TECHNOLOGY LIMITED (“we”, “us”, or “our”).
By downloading, accessing, or using BusFit, you agree to these Terms. If you do not agree, please do not use the App.
1. About BusFit
BusFit is an independent journey planning app currently designed to help users in Wellington, New Zealand compare public transport route options, estimated fares, walking time, walking distance, and possible fare-saving opportunities.
BusFit may provide features such as:
- route search;
- public transport journey options;
- walking guidance;
- estimated fare comparison;
- Walk & Save suggestions;
- Smart Wait suggestions;
- nearby stop or route information;
- navigation-related guidance.
BusFit is not a public transport operator. BusFit does not sell, issue, validate, or manage transport tickets. BusFit is not operated by, endorsed by, or officially affiliated with Metlink, Greater Wellington Regional Council, Google, Apple, or any public transport operator unless explicitly stated.
2. Route, fare, and journey information
BusFit provides route, fare, time, walking, and saving information for general guidance only.
Although we aim to provide useful and reasonable estimates, we do not guarantee that:
- route information will always be complete, accurate, or available;
- fare estimates will always match the final fare charged;
- saving estimates will always be achieved;
- public transport times will always be correct;
- walking time or walking distance will always match your actual journey;
- suggested routes will always be the safest, fastest, cheapest, most accessible, or most suitable option;
- public transport services will operate as shown.
The final fare is determined by the relevant transport operator, payment provider, ticketing system, or official fare rules.
Public transport information, fares, timetables, delays, cancellations, service changes, walking conditions, road conditions, and third-party data may change at any time.
You are responsible for checking official transport information, service alerts, fare rules, and real-world conditions before and during your journey.
3. Walk & Save and Smart Wait features
BusFit may suggest journey options that involve walking farther, walking to a different stop, crossing a fare boundary, or waiting for a later service.
These suggestions are estimates only. They are designed to help you compare possible options, not to guarantee a specific fare, saving, arrival time, or journey outcome.
You are responsible for deciding whether a suggested route, walking option, waiting option, transfer, or journey plan is safe, suitable, and appropriate for your circumstances.
You should consider:
- weather;
- lighting;
- traffic;
- road crossings;
- footpath conditions;
- personal safety;
- accessibility needs;
- mobility limitations;
- health and fitness;
- time of day;
- service reliability;
- local conditions.
You should always follow road rules, official signs, public transport instructions, and your own judgment.
4. Safety
Do not use BusFit in a way that distracts you while walking, crossing roads, cycling, driving, using public transport, or moving through public spaces.
You are responsible for your own safety and for complying with applicable laws and local conditions.
BusFit does not guarantee that any suggested walking route, stop, transfer, or waiting location is safe or suitable.
5. Location services
Some features require access to your device location.
You are responsible for enabling or disabling location permissions through your device settings. If location permissions are disabled, some features of BusFit may not work properly.

6. Acceptable use
You agree not to:
- misuse, overload, interfere with, or disrupt BusFit, its servers, or its third-party services;
- attempt to bypass quota limits, rate limits, security controls, or access restrictions;
- scrape, copy, harvest, extract, or reproduce App data at scale;
- use automated scripts, bots, emulators, fake devices, or other tools to generate excessive requests;
- reverse engineer, decompile, or attempt to extract the App's source code, except where permitted by law;
- use BusFit for unlawful, harmful, fraudulent, misleading, abusive, or commercial data extraction purposes;
- interfere with third-party services used by BusFit;
- use BusFit in a way that may cause us to breach third-party service terms;
- use BusFit in a way that creates unreasonable security, cost, quota, legal, or operational risk.
7. Rate limits, access restrictions, and service protection
To protect BusFit, normal users, and third-party API quota, we may apply technical controls including:
- rate limits;
- request limits;
- usage quotas;
- temporary restrictions;
- IP-based or device-based blocking;
- feature limitation;
- service suspension;
- other anti-abuse controls.
We may limit, suspend, block, or restrict access to BusFit if we reasonably believe that usage is abnormal, excessive, automated, abusive, harmful, unlawful, or likely to create security, cost, quota, legal, or operational risks.
8. Availability and changes
We may modify, suspend, limit, or discontinue any part of BusFit at any time.
We do not guarantee that BusFit will always be available, uninterrupted, secure, or error-free.
Some features may be changed, removed, limited, or temporarily disabled due to:
- technical issues;
- third-party API restrictions;
- quota limits;
- cost control;
- legal requirements;
- operational needs;
- security concerns;
- changes in public transport data or services.
9. Third-party services and data
BusFit may rely on third-party services, including map, route, location, place search, analytics, crash reporting, hosting, database, and infrastructure providers.
We are not responsible for:
- errors, outages, restrictions, or changes in third-party services;
- inaccurate, delayed, unavailable, or incomplete third-party data;
- public transport delays, cancellations, detours, or fare changes;
- decisions made by transport operators, public authorities, payment providers, or ticketing systems;
- losses caused by your reliance on estimated information shown in the App.
Your use of third-party services may also be subject to their own terms and privacy policies.
10. Intellectual property
BusFit, including its design, features, text, branding, software, and other content, is owned by us or licensed to us.
You may use BusFit for your personal, non-commercial use only.
You must not copy, modify, distribute, sell, lease, reproduce, or create derivative works from BusFit unless we give you written permission or the law allows it.
11. User feedback
If you send us feedback, ideas, suggestions, bug reports, or feature requests, you agree that we may use them to improve BusFit without owing you compensation.
You remain responsible for ensuring that any feedback you provide does not include confidential information that you do not want us to use.
12. Consumer rights
Nothing in these Terms limits or excludes any rights you may have under New Zealand consumer protection laws, including the Consumer Guarantees Act 1993 and the Fair Trading Act 1986, where those laws apply.
Where we are legally allowed to limit our liability, our liability will be limited to the maximum extent permitted by law.
13. Limitation of liability
To the maximum extent permitted by law, we are not liable for:
- indirect, incidental, special, or consequential loss;
- loss of data;
- loss of profit;
- loss caused by service outages;
- loss caused by inaccurate, delayed, or unavailable third-party data;
- loss caused by transport delays, cancellations, fare changes, route changes, or service disruptions;
- loss caused by walking route choices, waiting decisions, or transfer decisions;
- loss caused by your reliance on estimated route, fare, walking, saving, or timing information;
- loss caused by misuse, unauthorised use, automated requests, or breach of these Terms.
You use BusFit at your own discretion and risk.
14. No professional advice
BusFit provides journey planning information only.
It does not provide professional transport, safety, health, legal, financial, accessibility, or emergency advice.
You should use your own judgment and check official sources where necessary.
15. Termination
You may stop using BusFit at any time.
We may suspend or terminate your access to BusFit if you breach these Terms, misuse the App, create operational or security risks, or if we need to comply with legal or third-party service requirements.
16. Changes to these Terms
We may update these Terms from time to time. The updated Terms will be posted in the App or on our website with a revised “Last updated” date.
Continued use of BusFit after the Terms are updated means you accept the updated Terms.
17. Governing law
These Terms are governed by the laws of New Zealand.
Any dispute relating to these Terms or your use of BusFit will be subject to the courts of New Zealand, unless applicable law provides otherwise.
